Terms & Conditions for Ben Handyman LLC
SERVICES, SCOPE OF WORK AND CHANGES:
- All services will be performed as detailed in your written estimate from Ben Handyman LLC (“Provider”).
- Any additional services beyond the original estimate will incur extra charges at our current hourly rate.
- Any changes to specifications, quantities, schedule, or scope must be approved in writing (unless changes are under 2 hours, see below).
- Unseen issues that arise during service may result in additional work (defined as tasks requiring 2 hours or less), which will be performed at our current hourly rate without requiring prior written approval.
- Verbal agreements will not be considered binding.
- Changes that result in reduced work scope do not reduce the original estimate amount, as resources and time have been allocated based on the original scope.
- We reserve the right to decline any additional work requests that fall outside the original scope.
CANCELLATION AND SCHEDULING
- We require 24 hours’ notice for any cancellation or rescheduling.
- Less than 24 hours’ notice: 50% of service cost or $225 minimum charge (whichever is greater)
- Less than 2 hours’ notice or no-show: 75% of service cost or $225 minimum charge (whichever is greater)
- All cancellation fees must be paid before booking future appointments.
PROPERTY ACCESS
- Your estimate acceptance authorizes us to access your property for service-related needs.
- We provide an arrival window and will notify you when we’re on the way.
FOR GATED COMMUNITIES:
- Provide gate codes before your appointment.
- Billing starts at the gate.
- If we can’t access within 15 minutes and are forced to leave, rates subject to Cancellation and Scheduling policy apply.
WORK AREA REQUIREMENTS:
- Clear access to work areas required (furniture and belongings moved). Additional charges applied if provider needs to clear work areas.
- We may refuse service if conditions are unsafe or unsanitary.
PAYMENT TERMS
- Payment due upon work completion unless otherwise agreed in writing.
- Projects under $500 require deposit of our minimum charge of $225.
- Projects over $500 require 50% deposit.
- Late payments: $50 fee every 7 days past due date.
- Taxes are included in the cost of the service.
- Net billing terms: payment due by agreed date.
WARRANTY
Our 12-month guarantee covers all work and materials, with these conditions:
- Applies only to work we performed.
- Void if others modify our work.
- Void if work area is altered.
- Doesn’t cover normal wear and tear or misuse.
- Must notify us in writing of warranty claims within the 12-month period.
- We reserve the exclusive right to perform all warranty repairs.
- Limited to repair or replacement of defective work by our team only.
- No monetary compensation will be provided in lieu of repairs.
- Warranty work must be scheduled during normal business hours.
- If warranty repair access is denied or delayed, warranty may be voided.
LIABILITY AND INSURANCE
- We maintain general liability insurance.
- Please maintain your own property insurance.
- We’re not liable for pre-existing conditions.
- You’re responsible for permits unless agreed otherwise.
- We document and report any damage found during work.
DISPUTE RESOLUTION
- We’ll first try to resolve issues through direct discussion.
- If needed, we’ll use mediation before legal action.
- Winning party can recover legal fees in any court action.
WEATHER AND EMERGENCIES.
We may reschedule without penalty due to:
- Severe weather
- Emergencies
- Other circumstances beyond our control
